The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising from or related to these Terms.

The application of the United Nations Convention on Contracts for the International Sale of Goods and any similar international conventions is expressly excluded.

We reserve the right to amend or update these Terms and Conditions, our Privacy Policy, Cookie Policy, pricing, service information, or contractual terms at any time without prior notice. Any changes will take effect once published on this website.

These Terms constitute the entire agreement between you and Safety Spectrum London in relation to your use of this website and our services. No failure or delay by us in enforcing any provision shall be deemed a waiver of our rights unless expressly agreed in writing.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

1.12.1 Definitions

For the purposes of these Terms:

  • “Contract” means any legally binding agreement between you and us for the supply of Services, incorporating these Terms

     

  • “Services” means the property compliance, inspection, certification, or related services provided by us

     

  • “Normal Working Hours” means 09:00 to 18:00, Monday to Friday

     

  • “Order” means a request made by you to purchase a Service in accordance with these Terms

     

  • “Order Acknowledgement” means confirmation that we have received your Order

     

  • “Order Confirmation” means our written acceptance of your Order, forming a binding Contract

     

  • “Next Day” means the certificate or report will be issued on the next Working Day

     

  • “Working Day” means Monday to Saturday, excluding bank or public holidays

     

  • “Fixed Fee” means a stated price agreed for a specific Service

     

1.12.2 Orders

When you place an Order for a Service, this constitutes an offer to purchase that Service subject to these Terms. We reserve the right to accept or decline any Order at our discretion.

Upon receipt of your Order, we will issue an Order Acknowledgement. This does not constitute acceptance of your Order. A legally binding Contract is formed only when we issue an Order Confirmation, confirming service availability and booking details.

If there is any discrepancy between the Service requested and the Order Confirmation, you must notify us promptly. Failure to do so may result in delays or incorrect service delivery.

By placing an Order, you confirm that:

  • All information provided by you is accurate and complete

     

  • You are authorised to use the payment method provided

     

  • Sufficient funds or credit are available to cover the cost of the Services

     

1.12.3 Prices and Payments

All prices quoted are transparent and inclusive of applicable charges, unless otherwise stated. Services are invoiced at the price applicable at the time the Order is placed.

We reserve the right to amend our prices at any time. Price changes will not affect Orders that have already been confirmed.

Full payment must be received before inspection, service delivery, or certificate release, unless otherwise agreed in writing. Where payment has not been received, bookings may be marked as provisional and may be cancelled or rescheduled until payment is made.

Additional charges may apply where:

  • The property is located within a congestion charging zone

     

  • Paid parking is required

     

Any such charges will be added to the final invoice.

We accept major debit and credit cards and other approved payment methods. Certificates and reports will not be issued until payment has been received in full.

1.12.4 Call-Out Charges and Hourly Rates

A standard call-out charge applies when an engineer attends your property:

  • Gas, EPC, and PAT engineers: £59 per visit
  • Electrical engineers: £79 per visit

If more than one engineer attends the property, a separate call-out charge will apply for each engineer.

Where a fixed price cannot reasonably be agreed in advance, work will be charged at an hourly rate of £109 excluding the cost of parts and materials.

If an engineer attends the property and you decide not to proceed with the work for any reason, the applicable call-out charge remains payable and must be settled on the day.

You are responsible for ensuring suitable parking is available. Where the property is located in a restricted parking area, valid permits or paid parking must be provided.

1.12.5 Time Allocation for Appointments

We allocate five-hour appointment slots, Monday to Friday, on a first-come, first-served basis. The engineer may arrive at any time within the allocated slot.

In some circumstances, appointments may need to be rescheduled due to factors beyond our control. Where this occurs, we will contact you as soon as possible to arrange an alternative date and time.

1.12.6 Missed Appointments and Cancellations

If you need to cancel or rearrange an appointment, please notify us as soon as possible.

Cancellations made less than 12 hours before the scheduled appointment may incur an administration charge of £50.00.

A £60.00 charge per property, per engineer may also apply where an inspection cannot be completed due to reasons not attributable to us, including (but not limited to):

  • No access to the property
  • Incorrect address details provided
  • No access to gas or electrical supply or meters
  • A minor (under 16) being alone at the property
  • Any other circumstance preventing completion of the service

These Terms apply equally where access is arranged through a third party, such as a tenant or managing agent.

1.12.7 Quotations

We provide free quotations for required works. A written quotation, once accepted, forms the contractual agreement for the specified work.

Verbal agreements are not binding unless confirmed in writing. Quotes may be revised if the scope or nature of the work changes, including changes to labour or materials. Any revisions will be discussed with you before proceeding.

All quotations remain valid for 28 days from the date of issue.

1.12.8 Deposits

Deposits may be required to cover material costs. Deposits must be paid by telephone or online payment unless otherwise agreed.

Payment of a deposit and authorisation to proceed with work confirms your acceptance of these Terms and Conditions.

1.12.9 Termination of Contract

We reserve the right to terminate a project or withdraw services at any time.

We operate a zero-tolerance policy toward aggressive, abusive, discriminatory, or offensive behaviour (including racism, sexism, homophobia, ageism, or harassment) directed at our staff or contractors.

1.12.10 Your Right to Cancel

You may cancel your Order for any reason up to 24 hours before an engineer or assessor is due to attend the property.

Where cancellation is made in accordance with this section, any payments received will be refunded within 30 days of cancellation.

1.12.11 Provision of Services

We will carry out Services with reasonable care, skill, and professionalism, consistent with industry standards. Our work is warranted as free from defects for 30 days following completion.

We are not responsible for faults or damage not caused by our engineers or authorised contractors. Where a dispute arises regarding workmanship, we reserve the right to appoint an independent specialist to assess the work.

We accept no liability for equipment that has been altered, modified, or interfered with by third parties after installation.

Any remedial or maintenance work identified before or during a service will be reported to you. Such work is not included in the standard service and will be chargeable separately. Where remedial work is booked and completed at the same time, a discretionary discount may apply.

Certificates and reports are issued by email within 24–72 business hours, provided payment has been made in full. Where payment is delayed, certificates will be issued within 30 working days from the date payment is received.

1.12.12 Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure is caused by events beyond our reasonable control.

Events outside our control may include, but are not limited to: acts of God, extreme weather conditions, fire, flood, explosion, accidents, war or threat of war, civil unrest, terrorism, governmental or regulatory actions, changes in law, strikes or industrial disputes (whether involving our staff or third parties), shortages of materials or labour, transport disruption, power failures, or breakdown of equipment.

Where performance of the Services is affected by such events, we will seek to agree a revised timetable with you. If the Services cannot be provided within a reasonable period, either party may terminate the Order, and any prepayments made will be refunded in full.

1.12.13 Errors and Omissions

We take reasonable care to ensure that all prices, descriptions, and information provided on our website or in our quotations are accurate.

If a clear and obvious error or omission occurs, we reserve the right to correct the error and, where necessary, cancel the affected Contract. Where payment has already been made, our liability will be limited to refunding the amount paid for the affected Service.

Where an error relates to pricing, you may choose to proceed with the Service by paying the corrected price, as confirmed by us in writing, or cancel the Order and receive a full refund. For the purposes of these Terms, a “manifest error” means a pricing error that is materially incorrect and would reasonably be recognised as such.

1.12.14 Data Protection

We do not store credit or debit card details. Payment information is processed securely by approved payment providers.

We collect and process personal information in accordance with applicable data protection laws, including the UK GDPR. Information provided by you (such as name, contact details, address, and service details) is used for service delivery, customer communication, internal administration, and lawful marketing purposes where consent has been given.

We may share personal information with trusted third parties where necessary for service delivery, fraud prevention, or legal compliance. We may also carry out anti-fraud checks and share information with credit reference or fraud prevention agencies, which may retain records of such checks.

Inbound and outbound calls or electronic communications may be monitored or recorded for training, quality assurance, and security purposes.

1.12.15 General Terms of Business

Nothing in these Terms limits or affects your statutory rights as a consumer.

Certificates and reports will be issued by email within 24 to 72 business hours following completion of the Services, provided payment has been received in full. Where payment is delayed, certificates will be issued within 30 working days from the date payment is received.

Any variation to these Terms must be agreed in writing and authorised by a duly authorised representative of Safety Spectrum London.

You may not transfer or assign any Contract made under these Terms without our prior written consent, which will not be unreasonably withheld.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

No failure or delay by us in enforcing any provision shall constitute a waiver of that provision or any other provision.

These Terms are governed by and construed in accordance with the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
